- Resource Hogging: Consistently consuming excessive hardware resources (CPU, RAM, Disk I/O, network bandwidth) beyond your allocated plan limits in a manner that degrades performance for other tenant virtual environments on the same physical host node.
4. Backup Storage & Offsite Storage Vault Rules
Services designated for offsite backup storage, S3-compatible cloud storage, or backup vaults are optimized specifically for data protection and disaster recovery operations. Clients utilizing backup storage infrastructure must comply with the following rules:
A. Permitted & Intended Use
- Backup storage vaults are intended solely for legitimate system snapshots, database dumps, application state archives, server configuration backups, and business disaster recovery data.
B. Prohibited Storage Uses & Content Misuse
- No Public Content Delivery or Streaming: Storage vaults may not be configured as public Content Delivery Networks (CDNs), video streaming endpoints, image hosting platforms, or public file-download hubs.
- No File-Sharing or Torrent Nodes: Using backup containers as public file-sharing hubs, direct download mirrors, or peer-to-peer (P2P) torrent seeding/leeching nodes is prohibited.
- No Illegal Content Repositories: Storage archives must not contain pirated media collections, unlicensed software dumps, stolen databases, or illegally obtained personal data sets.
- No Active Production Databases: Backup storage may not be used as live, hot transactional production databases for high-frequency live web applications.
C. Data Security, Encryption, and Privacy Responsibilities
- Client Encryption Responsibility: Because offsite backups frequently contain confidential data, personal identifiable information (PII), or database credentials, Clients are strongly encouraged to apply client-side or zero-knowledge encryption (e.g., AES-256) to all backup archives before uploading them to our storage vaults.
- Sensitive Compliance Data: Clients are solely responsible for ensuring that data stored in backup vaults complies with applicable data protection regulations (e.g., GDPR, HIPAA, CCPA). AoE Web Services LLC acts as a Data Processor and does not inspect or manage the contents of private backup files.
D. API, Bandwidth, and Storage Overages
- API Abuse: Performing abnormal or excessive API request patterns (e.g., millions of unthrottled HEAD, GET, or DELETE operations) that overload storage cluster metadata indices is prohibited.
- Storage Quotas & Retention Upon Cancellation: If a client account is suspended or terminated for non-payment or AUP violations, AoE Web Services LLC reserves the right to purge backup vaults after 14 days, with no liability for data loss.
5. Game Server Hosting Terms & Conditions
Because multiplayer game server hosting involves unique network demands, high single-core CPU utilization, and interactive player communities, Clients provisioning game server instances (whether managed or unmanaged) must adhere to the following rules:
A. Unauthorized Private Game Servers & Piracy
- Clients may not host unauthorized private servers, server emulators, or leaked server software binaries for intellectual property they do not own or hold a valid commercial license to rehost (e.g., unauthorized World of Warcraft private realms, leaked closed-beta server files, or cracked server executables).
- All game server files, custom mods, and game binaries hosted on our servers must operate in full compliance with the original game developer’s or publisher’s End User License Agreement (EULA) and Terms of Service (e.g., Minecraft Commercial EULA).
B. Cheats, Hacks, Exploits & Booters
- Cheats & Hacks Distribution: Hosting, selling, or distributing game cheats, aimbots, wallhacks, duping scripts, or memory-injection tools designed to undermine online game mechanics is prohibited.
- Booters & Stressers: Operating "IP Stresser," "Booter," or DDoS-for-hire platforms from any game server or node is prohibited and will result in immediate service termination without notice.
C. Game Server Resource Abuse & Overloading
- Excessive Plugin/Mod Overhead: You are responsible for optimizing your game server's plugins, scripts, and configuration files. Running poorly optimized, memory-leaking, or corrupted mods that cause sustained 100% CPU lockup across shared host threads, or crash parent virtualization daemons (e.g., Docker/Pterodactyl wings), is prohibited.
- Map Rendering & Heavy Background Tasks: Generating map renders (e.g., Dynmap, BlueMap) or running heavy file compression archives must be throttled to off-peak hours or run with restricted thread counts so as not to starve host system resources.
- Background Applications: Running non-gaming applications (such as video rendering, web scrapers, or heavy database indexing) inside a game server instance is prohibited unless explicitly permitted by your plan.
D. DDoS Targets & Mitigation
- While AoE Web Services LLC utilizes enterprise DDoS mitigation tools , if a Client’s game server becomes the target of recurring, large-scale, or unmitigated DDoS attacks that threaten host node integrity or upstream provider stability, we reserve the right to temporarily null-route the target IP address or require the Client to upgrade to dedicated mitigation infrastructure.
E. Community Moderation, Player Behavior & COPPA Responsibility
- Community Moderation Disclaimer: AoE Web Services LLC acts as an infrastructure provider (Data Processor). We do not monitor, moderate, or control in-game text chat, voice chat servers, or player interaction within client-operated game communities.
- Client Responsibility: As the game server owner/administrator, you are solely responsible for moderating your player base, handling player disputes, enforcing your server rules, and ensuring your community complies with applicable law.
- Minors & COPPA Compliance: If your game server targets or is accessible to players under 18 years of age (or under 13), you—as the Data Controller for your server—are solely responsible for complying with the Children’s Online Privacy Protection Act (COPPA) and applicable youth privacy laws.
6. System Security & Account Integrity
- Clients are responsible for maintaining the security of their server credentials, administrative passwords, SSH keys, panel API tokens, and WHMCS client portal logins.
- If a Client server is compromised (e.g., a WordPress site infected with malware or a game server turned into a spam/DDoS botnet node), the Client must immediately cooperate with our technical support team to isolate and clean the infected files.
7. Enforcement & Action Policy
AoE Web Services LLC reserves the right to determine, whether a service usage pattern constitutes a violation of this Acceptable Use Policy.
- Suspension & Shutdown: In the event of a severe violation (e.g., ongoing DDoS attack outbound, CSAM hosting, or malware distribution), we reserve the right to immediately suspend or terminate the offending server or account without prior notice.
- Notice & Cure Period: For minor resource or configuration issues (e.g., runaway plugin CPU usage or minor mod leaks), we will issue a ticket via our billing portal allowing the Client 12–24 hours to resolve the issue before taking administrative action.
- No Refunds on Termination: Any service suspension or termination resulting from a violation of this AUP forfeits all rights to account refunds or credit adjustments.
- Legal Disclosure: We reserve the right to cooperate fully with law enforcement agencies or court orders investigating illegal activities originating from our infrastructure.
- Immediate Suspension for Material Harms: Immediate action without prior notice is reserved for severe, objective threats (e.g., outbound attacks, active malware distribution, CSAM hosting, or unmitigated DDoS targeted at node integrity).
- Notice & Cure Period for Non-Emergency Violations: For non-critical or minor configuration issues (e.g., runaway plugin CPU usage or unthrottled background tasks), we will issue a ticket via our billing portal granting 12–24 hours to cure before taking administrative action.
- Determination of Violations: AoE Web Services LLC will make reasonable, good-faith determinations as to whether a client’s activity or resource utilization constitutes a violation of this AUP. Such determinations will be grounded in objective technical, security, and legal criteria, including but not limited to:
Technical & System Logs: Server telemetry showing sustained hardware, bandwidth, or I/O degradation affecting neighboring tenants.
Security & Threat Indicators: Verified malware hashes, outbound attack signatures (DDoS/port scans), or compromised credentials.
